Legal
Terms of Service
Please read these Terms of Service and our Privacy Policy before placing an order. By checking the applicable consent box and submitting an order, you confirm that you have read, understood, and agreed to these Terms. If mandatory law gives you rights that cannot be waived or limited, those rights continue to apply.
1. Eligibility and Scope
These Terms govern PaleSnow’s AI-assisted custom music production, gifting, digital delivery, one free full remake, and related customer support services.
You must be at least 18 years old and legally able to enter into a binding contract. If you place an order on behalf of a company or other organization, you represent that you have authority to accept these Terms on its behalf.
2. AI-Assisted Music Production
PaleSnow uses a combination of customer instructions, human-designed workflows, software, and third-party artificial intelligence systems to create music. The delivered music is generated in whole or in part through AI-assisted production.
AI-generated music is inherently uncertain. Song length, genre, mood, voice, pronunciation, lyrics, arrangement, structure, instrumentation, timing, and other preferences submitted by you are production goals rather than guarantees of exact results. The output may reasonably differ from your instructions, and separate generations may produce different results even when similar instructions are used.
AI systems have technical limitations. A delivered song may contain minor artifacts, unusual transitions, imperfect pronunciation, vocal inconsistencies, timing variations, repetition, background noise, musical irregularities, or other imperfections associated with AI generation. PaleSnow applies reasonable production and quality-review processes, but we do not guarantee that any song will be flawless, error-free, or indistinguishable from a recording produced entirely by human performers and engineers.
We do not guarantee that any output will qualify for copyright registration, trademark protection, Content ID, distribution, monetization, or acceptance by a streaming service, distributor, advertising platform, or any other third party.
The Service involves AI-assisted production. You must not falsely or deceptively represent a delivered song as having been created entirely by humans where such a representation would mislead others or violate applicable law or platform rules.
3. Your Order Information
You must provide a valid and usable email address and accurate order information. You must submit the required music preferences shown on the order page. If vocals or lyrics are requested, you must also provide the requested language and vocal preferences.
We may request changes to, reject, suspend, or cancel an order that is incomplete, unrelated to music production, unlawful, harmful, or likely to infringe another person’s rights. We may also reject requests to reproduce an existing song, melody, recording, or lyrics, or to imitate the identifiable voice or style of a specific living artist or other real person.
If you provide a YouTube link or another public music reference, it may be used only to understand general musical characteristics such as tempo, energy, mood, or structure. We will not intentionally reproduce the referenced recording, melody, or lyrics. Reference analysis may be unavailable or unsuccessful; if a required reference cannot be analyzed before payment, the order process will stop rather than silently ignore that reference.
4. Prices, Payment, and Order Formation
The applicable price, currency, discount, tax, target song length, product scope, and payment method are those displayed at Checkout and saved in the order record when you confirm the purchase.
Your card issuer, digital wallet provider, or payment institution may charge foreign-exchange or cross-border fees. PaleSnow does not collect or control those fees.
A paid order is formed only after our payment provider confirms successful payment. A fully discounted order is formed only after the system validates the discount and creates the order. A success message displayed in your browser does not replace server-side payment verification.
Discount codes may be subject to expiration dates, quantity limits, product restrictions, or other stated conditions. Unless mandatory law requires otherwise, discounts have no cash value and may not be resold or exchanged for cash.
5. Start of Production, Cancellation, and Refunds
The Service produces personalized digital content based on your instructions and delivers it without a physical medium. You request and agree that PaleSnow may begin processing and production immediately after payment is confirmed.
Where permitted by applicable law, and only after we have provided clear pre-purchase notice and obtained your express prior consent, a customized service or non-physical digital-content order may not qualify for a statutory cooling-off or unconditional cancellation period after production begins.
To the maximum extent permitted by applicable law, all fees become non-refundable once PaleSnow has successfully generated the initial song for your order. A successful generation occurs when our system produces a playable initial song file for the order, whether or not you have listened to or downloaded it.
This non-refundable policy applies if you dislike the song, change your mind, prefer a different creative direction, or identify imperfections associated with AI generation. Your standard remedy for those concerns is the one free full remake described in Section 9, not a refund. Using, declining, or being dissatisfied with that remake does not make the order refundable.
This section does not limit any non-waivable rights you may have regarding non-performance, a technical error that results in no music being generated, duplicate charges, incorrect charges, or other remedies required by applicable law.
For purposes of this refund policy, a technical error means that no playable music file was generated for the order. Disliking the result, preferring a different creative direction, or identifying pronunciation issues, artifacts, repetition, stylistic differences, or other AI-generated imperfections does not constitute a technical error.
Unless mandatory law or the applicable Checkout terms provide otherwise:
- You may submit a cancellation or refund request within 24 hours after the authoritative payment time only if successful generation has not yet occurred. Submitting a request does not mean that it has been approved, and production may begin immediately after payment.
- If a technical error results in no music being generated for your order, please contact customer support with your order number to request a refund. The order is not considered refunded until the payment provider confirms completion.
- A failure during the free remake process does not automatically restore the remake entitlement. Customer support will review the case.
- A redeemed music-generation gift, or an order for which production has already started, is no longer eligible for a refund solely on the basis that the gift was unused.
Approved refunds will normally be returned to the original payment method. The timing of the final credit is controlled by the relevant payment provider or financial institution.
6. Your Content and Required Rights
You retain your rights in the text, lyrics, recordings, stories, images, references, and other materials you submit to us.
You represent and warrant that:
- You own or have obtained all rights, permissions, licenses, and consents necessary to submit and process your content.
- Your content does not infringe copyright, trademark, privacy, publicity, voice, likeness, personality, or other rights belonging to another person.
- If your content includes another person’s personal information, story, name, image, or identifiable voice, you have obtained all legally required consent.
- You will not request the reproduction of a particular song, album, recording, melody, lyrics, or other protected work, or the deceptive imitation of an identifiable artist, performer, songwriter, or other real person.
To provide the Service, you grant PaleSnow a non-exclusive, royalty-free license to store, process, modify, transform, and transmit your content, and to allow necessary service providers to do the same, solely to the extent reasonably necessary to produce and deliver your order, perform quality and safety checks, provide customer support, handle disputes, comply with law, and maintain information security.
Third-party AI providers may apply different data terms depending on the provider, product, region, and paid-service status. Some services may retain limited records for service delivery, security, abuse prevention, or legal compliance and may process data across borders. As described in the Privacy Policy, PaleSnow may use anonymized creative features and quality feedback to train internal models that understand music requests and assess output quality. This does not authorize training a music-generation model or using identifiable customer stories, lyrics, or audio as training examples.
Do not include unnecessary identity documents, financial information, medical information, passwords, intimate images, or other highly sensitive personal information in your story, lyrics, references, or production instructions.
7. Rights to Use Delivered Music
Subject to full payment and your compliance with these Terms, you may use, reproduce, edit, distribute, publicly perform, license, sublicense, sell, resell, and monetize the delivered song for any lawful personal or commercial purpose, to the extent PaleSnow has the legal right to grant those permissions and subject to applicable law and third-party rights.
Your license does not include:
- A guarantee of exclusive copyright ownership or the ability to prevent others from using identical or similar content.
- Ownership of PaleSnow’s or any third-party provider’s software, models, systems, trademarks, or technology.
- Any right to use the song unlawfully, infringe another person’s rights, misrepresent its origin, or use it to train or improve an AI or machine-learning model.
AI output may not be unique. Another person may receive identical or similar output, and some jurisdictions may not recognize copyright in material generated entirely or substantially by AI. PaleSnow does not guarantee copyright registration, Content ID eligibility, distributor acceptance, monetization, or freedom from ordinary similarities with third-party content.
8. Prohibited Content and Uses
You must not use the Service or any delivered song for unlawful, fraudulent, deceptive, harassing, hateful, discriminatory, violent, sexually exploitative, privacy-invasive, impersonating, or rights-infringing activity.
You must not:
- Present a song as having been created, performed, endorsed, sponsored, licensed, or approved by a real artist, songwriter, rights holder, PaleSnow provider, or other person when that is not true.
- Deceptively claim that AI-assisted music was created entirely by humans or falsify its origin or production method.
- Remove, obscure, falsify, or circumvent any source identifier, watermark, fingerprint, metadata, or legal notice that applicable law or a service provider requires to remain intact.
- Reverse engineer, interfere with, abuse, automate access to, or bypass the restrictions or safety systems of the Service.
- Use the Service or delivered music to train, fine-tune, test, or improve another AI or machine-learning model.
- Give another person rights broader than those granted to you under these Terms or the applicable order license.
We may reject orders involving restricted industries, political campaigning, government activity, controlled substances, weapons, adult entertainment, or other subjects that cannot be processed under applicable law or provider rules.
9. One Free Full Remake
Unless the applicable order page states otherwise, each order with a successfully generated initial song includes one free generation opportunity for a complete remake.
A remake creates a new complete version of the song. It is not a promise to repair or replace only a particular word, note, vocal phrase, instrument, section, or technical artifact. Because the remake is also produced using AI-assisted systems, it is subject to the same uncertainty and technical limitations described in Section 2.
For new orders under this version, you must submit your remake request through the valid delivery page within 7 calendar days after initial delivery. The remake keeps the purchased 1-, 2-, or 3-minute target and original reference materials. You may clarify or revise the creative direction, but cannot change the purchased duration or replace the original reference link. Earlier orders retain the remake entitlement recorded at purchase.
The original version will be preserved and will not be overwritten merely because you request a remake.
We will use reasonable efforts to follow your remake instructions, but the free remake does not guarantee a perfect or flawless result, complete removal of every artifact, exact pronunciation, exact timing, or satisfaction of every subjective preference. AI-generated music remains subject to technical limitations and uncertainty. Unless required by law, dissatisfaction with either version does not create a right to additional free generations, remakes, edits, or refunds.
Once the initial song has been successfully generated, the order remains non-refundable before, during, and after the remake process, except where applicable law requires otherwise.
The remake entitlement is reserved when the system accepts the request. Repeated submissions of the same request do not create additional entitlements. Requests requiring human review or generations affected by technical failure may be referred to customer support.
The accepted remake is delivered within 7 business days. It has its own access deadline, shown on the delivery page; requesting or receiving it does not restart or extend access to the original version.
10. Delivery, Download Access, and Storage
Paid orders enter a production queue. You can close the page while waiting: when your song is ready, we email the protected playback and download page to your order address. Gift notifications go to the verified recipient address; a private-link recipient must bind an email address to receive email delivery.
Unless the applicable order states otherwise, the delivery credential and access to the completed song remain available for 30 days from the authoritative delivery time. Temporary page credentials and individual signed file URLs may have shorter security expiration periods and may be refreshed only while the main delivery access remains valid.
Each version has a separate 30-day access window. For a gift remake, the window starts when the remake request is accepted; the precise deadline is shown on the gift page. Reopening a page, resending email, claiming a gift, binding an email, recovering access, or downloading does not restart an existing window.
Expiration of an access link does not necessarily mean that the order, payment record, support record, backup, or audio file has been immediately deleted. Actual retention and deletion practices are described in our Privacy Policy.
You are responsible for downloading and securely backing up each version you wish to keep before the access period expires. PaleSnow does not provide permanent cloud storage, permanent playback, or guaranteed re-delivery after expiration.
11. Gift Orders
This section applies only when gifting features are available on the website.
The purchaser remains the owner of the payment and refund relationship. The recipient is a separate role and may receive only the access granted through the applicable gift flow.
For a song completed by the purchaser before gifting, the song will not be sent to the recipient until the purchaser expressly sends it. After sending, the purchaser may not access the recipient’s remake instructions or later versions.
For a gift that allows the recipient to create the song, the generation opportunity must be redeemed within 60 days after the authoritative payment time. Opening an invitation does not itself redeem the gift. The gift is redeemed when the system accepts a valid music request and creates the single permitted generation request.
A purchaser may request an unused-gift refund only within 24 hours after payment and only before redemption or production begins, subject to Section 5 and applicable law. Once redeemed or placed into production, the gift is no longer refundable solely because it is unused.
Private gift links operate as bearer credentials. Anyone who obtains the link may be able to claim it first. Human-verification checks do not prove that the person claiming the link is the intended recipient. The purchaser is responsible for sending the link only to the intended recipient.
Playback and download access for the original completed gift remains available for 30 days from the authoritative sending or delivery time. Resending, late claiming, email binding, account recovery, or a free remake does not restart or extend that original period. An accepted gift remake has the separate deadline described in Section 10.
12. Third-Party Services
PaleSnow may use third-party services for payment processing, databases, cloud storage, email delivery, background processing, analytics, reference analysis, and AI-assisted text or music generation.
Third-party services may process data under their own terms and privacy policies. Availability, pricing, policies, models, safety controls, licensing conditions, and technical behavior may change or be interrupted.
The names and categories of applicable processors will be identified in our Privacy Policy or service-provider list where appropriate. Identifying a service provider for privacy or legal compliance does not require PaleSnow to disclose the provider or model used for a particular public song.
We will not reduce an express right recorded in an already formed order merely because we change an internal provider. If a legal, technical, platform, or provider restriction makes performance unlawful or impracticable, we may stop an incomplete order and offer a reasonable replacement, remediation, or refund.
13. Service Availability and Changes
We use reasonable efforts to maintain the Service, but we do not guarantee that the website, payment system, AI generation, email delivery, downloads, or any third-party service will always be available, uninterrupted, timely, secure, or error-free.
Maintenance, security incidents, legal requirements, provider changes, rate limits, system capacity, or events beyond our reasonable control may delay or prevent production or delivery.
We may change products, prices, features, and available regions for future orders. An existing order will generally be governed by the price, core product scope, license, and Terms version saved when that order was formed, unless a change is required by law or expressly agreed by both parties.
14. Refusal, Suspension, and Termination
We may reject, suspend, or terminate an order or revoke related access credentials if the order or your conduct violates these Terms, applicable law, third-party rights, safety requirements, provider restrictions, or payment rules.
Refund eligibility will depend on the circumstances, work already performed, costs already incurred, the reason for suspension, and applicable law.
If we cannot lawfully or technically complete a paid order for reasons attributable to PaleSnow or a required provider, we will offer a reasonable reprocessing attempt, alternative solution, or refund as appropriate.
15. Disclaimers
To the maximum extent permitted by law, the Service and delivered music are provided on an “as is” and “as available” basis.
PaleSnow does not warrant that:
- AI-generated music will be perfect, free of artifacts or defects, or identical to your expectations.
- Every instruction or preference will be followed exactly.
- A free remake will correct every issue or produce a subjectively preferable version.
- The Service will be uninterrupted or error-free.
- Delivered music will be unique, copyrightable, non-infringing, accepted by a third-party platform, or eligible for distribution, Content ID, or monetization.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
16. Limitation of Liability
To the maximum extent permitted by law, PaleSnow will not be liable for indirect, incidental, special, exemplary, or consequential loss, including loss arising from third-party platform rejection, Content ID disputes, lost monetization, loss of data, or your failure to download and back up a song before access expires.
Except in cases of intentional misconduct, gross negligence, personal injury, mandatory consumer-protection liability, or another liability that cannot lawfully be limited, PaleSnow’s total liability arising from a single order will not exceed the amount actually paid to PaleSnow for that order.
This section does not limit any right or liability that applicable law does not permit us to exclude or limit.
17. Privacy and Data Processing
Our Privacy Policy explains how we collect, use, store, share, transfer, and delete personal information. Declining optional analytics does not prevent you from placing an order or using core Service functions.
Payment card details are processed by the applicable payment provider and are not stored in PaleSnow’s application database. The Privacy Policy describes the data categories, service providers, purposes, retention periods, cross-border processing, deletion procedures, and backup limitations applicable to music instructions, lyrics, references, customer-support content, and delivered files.
18. Terms Versions and Changes
Each order will record the version of these Terms that you accepted and the corresponding acceptance time.
Updated Terms generally apply only to orders formed after the new version becomes effective. If a change materially affects an existing order, we will provide notice or obtain additional consent where required by law.
If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision immediately does not waive the right to enforce it later.
19. Governing Law and Disputes
These Terms are governed by applicable law, without excluding any mandatory protection available to a consumer.
Before starting formal proceedings, you and PaleSnow should first attempt to resolve the dispute in good faith through customer support. Nothing in these Terms limits any mandatory consumer venue or dispute-resolution rights.
20. Contact Information
Customer support: support@palesnow.com
When contacting us, include your order number. An email address alone is not sufficient proof of identity for access to songs, download links, gift credentials, or refunds.
Privacy
Privacy Policy
This Privacy Policy explains how PaleSnow collects, uses, stores, shares, and protects personal information when you visit the website, place an order, receive or redeem a gift, request a remake, download music, or contact customer support.
1. Who Is Responsible
PaleSnow is responsible for the personal information processed through the Service. Privacy questions and requests may be sent to support@palesnow.com. Please include the relevant order number where available. We may need to verify your identity before providing access to, changing, or deleting information.
2. Information We Collect
Depending on how you use the Service, we may collect:
- Contact and order information: email address, order number, order status, timestamps, price, currency, discount or referral information, and consent records.
- Creative content and preferences: stories, themes, genres, moods, intended uses, language and vocal preferences, lyric instructions, lyrics, exclusions, optional reference links, remake instructions, and other information you submit.
- Gift and recipient information: purchaser and recipient email addresses, gift messages, redemption and delivery choices, and related access records when gifting features are available.
- Payment and refund information: payment status, transaction identifiers, amounts, currency, limited fraud-prevention information, and refund records. PaleSnow does not store full payment-card details.
- Generated content and delivery activity: generated music files, technical file information, delivery and download-token hashes, link expiration, access, download, remake, and delivery timestamps.
- Support information: sender and recipient addresses, message subject and content, order references, support history, and technical delivery information associated with support email.
- Technical and security information: browser or session identifiers used to prevent duplicate orders and show order progress, IP address or IP-derived rate-limit data, request and error logs, and security events.
Please do not submit unnecessary identity documents, financial information, medical information, passwords, intimate material, or other highly sensitive information in an order or support request.
3. How We Use Information
We use personal information to:
- Validate requests, form orders, process payments and discounts, prevent duplicate transactions, and manage refunds.
- Review content for safety and scope, prepare production instructions, generate and quality-check music, provide one eligible remake, and deliver completed files.
- Send transactional messages, operate protected delivery links, respond to support requests, and resolve disputes.
- Maintain structured music-preference history for future personalization and produce aggregated service trends. You may object to this use or request deletion through customer support; doing so does not affect processing needed to complete an existing order.
- Prepare anonymized creative features and quality feedback to improve internal models for understanding music requests and assessing output quality, subject to the safeguards below. The order notice combines these disclosed purposes with acceptance of our Terms and Privacy Policy; analytics controls remain separate.
- Protect the Service, enforce these Terms, investigate misuse, maintain records, comply with law, and establish or defend legal claims.
Depending on applicable law, these activities are based on performance of a contract, steps requested before entering a contract, consent where specifically requested, compliance with legal obligations, and PaleSnow’s legitimate interests in operating and securing the Service without overriding your rights.
4. AI-Assisted Processing and Reference Links
Your creative instructions and related order content may be reviewed and transformed by automated systems and sent to third-party AI services for content checking, prompt preparation, and music generation. The information shared is limited to what is reasonably necessary for those functions.
If you provide a public reference link, we may process the link and information available from the referenced service to understand general musical characteristics. A reference may not always be analyzed.
Internal model improvement is limited to understanding requests and assessing output quality, not generating music. Before any training use, candidate data must be checked for identifying content and applicable usage rights. Removing an email address or order number alone is not anonymization. Raw customer stories, lyrics, reference links, recordings, audio embeddings, and identifiable support messages are excluded from this training use. We do not apply this expanded purpose retroactively to earlier orders without an appropriate basis.
Third-party AI services may process or retain limited records under their own terms for service delivery, security, abuse prevention, or legal compliance. Do not include personal information that is unnecessary for creating the song.
5. Service Providers and International Processing
We may share information with service providers that support payment processing, databases, encrypted data storage, private audio storage, website hosting and network delivery, transactional email and customer support, background workflow processing, reference analysis, content-safety review, and AI-assisted text or music generation.
These providers may process information in Taiwan, the United States, or other locations where they or their subprocessors operate. Where required, we use contractual or other appropriate safeguards for cross-border processing. We may also disclose information when required by law, to protect rights or safety, or in connection with a business reorganization subject to appropriate protections.
We do not currently sell personal information for money or use customer order content for third-party behavioral advertising.
6. Payment Information
Payment-card and digital-wallet details are collected and processed by the payment provider. PaleSnow receives and stores only the transaction information needed to confirm payment, reconcile orders, prevent fraud or refund abuse, process refunds, and keep required financial records. Your financial institution may process additional information under its own policies.
7. Storage, Access Periods, and Retention
Order instructions and customer-support content are stored in encrypted form in PaleSnow’s application database. Generated audio is stored in private object storage. Access credentials are stored as cryptographic hashes rather than readable tokens where supported by the delivery system.
Customer playback and download access normally remains available for 30 days from the authoritative delivery time. Browser-session credentials and individually signed file URLs expire sooner for security. These access periods control access only and do not mean that the underlying order, payment, support, security, backup, or audio records are deleted at the same time.
- Creative briefs and reference analysis: 12 months after the last version is delivered.
- Saved preferences: 12 months from the most recent consent, or earlier when an applicable deletion or withdrawal request is fulfilled.
- Support records: 12 months after the case closes.
- Backups: up to 12 months from creation. Backup copies are restricted to recovery; deletion and withdrawal records must be reapplied before restored data returns to ordinary use.
Relevant dispute material may be isolated and retained for the dispute and applicable legal requirements. Payment, refund, accounting, tax, and necessary compliance records follow their separate legal and business retention requirements, not the 12-month creative-data schedule. Access expiry is not a promise that every stored audio or backup copy is immediately deleted.
8. Security
We use administrative and technical safeguards appropriate to the nature of the information, including encryption for sensitive order and support content, restricted backend access, row-level database controls, private audio storage, hashed delivery credentials, access expiration, and security monitoring. No online service can guarantee absolute security.
9. Browser Storage and Analytics
The order flow uses necessary first-party browser storage, including session storage, to prevent duplicate submissions and display order progress. Clearing it may interrupt browser-based progress recovery, but valid delivery email links remain the primary route to completed music.
Where analytics is enabled, our analytics setting controls whether browser identifiers and events are sent for traffic and conversion measurement. Use Analytics settings to decline or withdraw tracking; the core order service remains available. Analytics identifiers are not permission to access an order or its music, and the financial transaction ledger remains separate from analytics reports.
10. Your Rights and Choices
Subject to applicable law, you may request confirmation of processing, access to or a copy of your personal information, correction, cessation of collection or use, deletion, withdrawal of consent where consent is the basis, or objection to certain processing.
Send requests to support@palesnow.com and include your order number where available. We may ask for additional verification and may retain information when required for payment, accounting, fraud prevention, disputes, security, or legal compliance. You may also complain to the competent data-protection authority where that right applies.
You may object to personalization or internal model-improvement use through that same support address without canceling processing needed to fulfil an existing paid order. After verification, we stop the affected future use and review linked source data and training candidates. We will explain any required retention or any limitation involving data already irreversibly anonymized; we do not promise to identify anonymous records or reverse every prior model update.
If required information is not provided, we may be unable to create the order, process payment, generate or deliver the song, provide a remake, or handle the related support request.
11. Children
The Service is intended for people who are at least 18 years old. We do not knowingly accept orders from children. If you believe a child has provided personal information, contact customer support.
12. Policy Changes
We may update this Privacy Policy to reflect legal, operational, or service changes. The version accepted for an order and the corresponding acceptance time will be recorded. Material changes affecting existing processing will be communicated or submitted for additional consent where required by law.
